Fundraising Terms and Conditions

  1. IntroductionWelcome to the Centre for Social Responsibility and Accountability (CESRA). By engaging CESRA to manage and facilitate fundraising efforts on behalf of your charity or organization, you agree to the following terms and conditions.
  2. Scope of ServicesCESRA will provide the following services:
    • Creation and management of fundraising campaigns on behalf of affiliated charities and organizations.
    • Development of compelling narratives and stories to promote each campaign.
    • Hosting and maintaining a dedicated community page on CESRA’s crowdfunding platform or any other third-party platform where donors can select and contribute to the charity of their choice.
  3. Account Management:  Each charity or organization will have an individual campaign managed under the CESRA community page. CESRA reserves the right to create, edit, and manage all fundraising content and campaigns.
  4. Fund Withdrawal and Fees CESRA will charge a 15% fee on all funds withdrawn from CESRA’s crowdfunding platform or other third-party platforms. This fee covers administrative costs, platform fees, and the management of the fundraising campaigns.
    • Withdrawals will be processed in accordance with CESRA’s policies and procedures.
    • Withdrawals can be requested once a month, specifically on or before the 15th of each month.
    • Withdrawal amounts must be greater than 5000 Ksh.
    • If a withdrawal request is not made by the 15th of the month, funds will be disbursed in the following month’s cycle on the 15th.
    • Charities and organizations must fill out the withdrawal request form provided on their account section of the CESRA website to initiate the withdrawal process.
  5. Terms of Withdrawal of Funds

    1. Eligibility for Withdrawal

    • Funds can only be withdrawn by the campaign organizer or an authorized representative.
    • The campaign must have met any specified minimum funding goals before funds can be withdrawn.
    • All necessary documentation and verification must be completed and approved before funds are released.

    2. Withdrawal Requests

    • Withdrawal requests must be submitted through the official withdrawal form provided by the platform.
    • All information provided in the withdrawal request must be accurate and truthful.
    • Withdrawal requests may be subject to review and approval by the platform’s verification team.

    3. Verification Process

    • The campaign organizer must provide proof of identity (e.g., government-issued ID).
    • The campaign organizer may be required to provide documentation detailing the intended use of the withdrawn funds.
    • The platform reserves the right to request additional information or documentation to verify the withdrawal request.

    4. Processing Time

    • Withdrawal requests will be processed within 3 business days from the date of approval.
    • The processing time may vary depending on the method of withdrawal chosen and the completion of the verification process.

    5. Payment Methods

    • Withdrawals can be made via bank transfer, PayPal, Mobile Money, or other approved payment methods.
    • The campaign organizer must provide accurate payment details for the chosen withdrawal method.
    • The platform is not responsible for delays or issues caused by incorrect payment details provided by the campaign organizer.

    6. Fees and Charges

    • Withdrawal transactions may be subject to processing fees, which will be deducted from the withdrawal amount.
    • Any applicable taxes or charges imposed by financial institutions will be the responsibility of the campaign organizer.

    7. Use of Funds

    • Withdrawn funds must be used solely for the purposes outlined in the campaign.
    • The campaign organizer must provide updates and transparency regarding the use of funds to backers if required by the platform.

    8. Fraud and Misuse

    • Any fraudulent activity or misuse of withdrawn funds will result in immediate suspension of the campaign and potential legal action.
    • The platform reserves the right to withhold or reclaim funds in cases of suspected fraud or violation of terms.

    9. Dispute Resolution

    • Any disputes arising from the withdrawal of funds will be resolved in accordance with the platform’s dispute resolution policy.
    • The platform’s decision on disputes shall be final and binding.

    10. Amendments

    • The platform reserves the right to amend these terms of withdrawal at any time.
    • Campaign organizers will be notified of any significant changes to these terms.
  6. Use of Funds: All funds raised through CESRA-managed campaigns will be used solely for the purposes specified in the campaign narratives. CESRA requires transparency and accountability from all affiliated charities and organizations regarding the use of funds. Any misuse of funds by affiliated charities and organizations may be subject to a CESRA report of fund misuse, which is a public watchdog report that CESRA publishes.
  7. Responsibilities of Affiliated Charities and Organizations
    • Provide accurate and truthful information regarding the purpose and needs of the fundraising campaign.
    • Ensure timely communication and cooperation with CESRA for the management and promotion of the campaign.
    • Agree to the 15% withdrawal fee and acknowledge that this fee will be deducted from the total funds raised.
  8. Termination of Services: CESRA reserves the right to terminate the fundraising services for any charity or organization that fails to comply with these terms and conditions. Charities and organizations may also request termination of services, with the understanding that any ongoing campaigns will be closed and remaining funds (after the deduction of the withdrawal fee) will be disbursed.
  9. Liability: CESRA will not be held liable for any misuse of funds by the affiliated charities and organizations. CESRA is not responsible for the success or failure of any fundraising campaign.
  10. Amendments: CESRA reserves the right to amend these terms and conditions at any time. Any changes will be communicated to the affiliated charities and organizations and will take effect immediately upon such communication.
  11. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of Kenya.
  12. Prohibited Uses
    • Users may not use the crowdfunding platform for activities that are illegal, harmful, or that violate any local, national, or international law or regulation. This includes, but is not limited to, funding activities related to terrorism, money laundering, human trafficking, drug trafficking, or any form of organized crime.
  13. User Verification and Due Diligence
    • CESRA reserves the right to verify the identity of all users and the legitimacy of their campaigns. Users must provide accurate and complete information during the registration and campaign creation process.
    • CESRA may conduct due diligence on any campaign and its organizers, including background checks and the examination of financial records. CESRA reserves the right to remove or suspend any campaign or user account if we suspect any illegal activity or violation of our terms.
  14. Monitoring and Reporting
    • CESRA actively monitors campaigns and user activity on our platform. Users are encouraged to report any suspicious activity or campaigns that they believe may be in violation of these terms. CESRA will investigate all reports and take appropriate action, which may include reporting to law enforcement agencies.
  15. Suspension and Termination
    • CESRA reserves the right to suspend or terminate any user account or campaign at our sole discretion if we believe it is associated with illegal activities. Funds raised in connection with such activities may be frozen and reported to the appropriate authorities.
  16. Indemnification
    • Users agree to indemnify and hold harmless CESRA, its affiliates, and its employees from any claims, losses, liabilities, and expenses arising from or related to the user’s violation of these terms or any applicable law.
  17. Disclaimer of Liability
    • CESRA does not endorse or guarantee the legitimacy of any campaign on our platform. Users acknowledge that they use the platform at their own risk, and CESRA is not liable for any damages or losses resulting from illegal activities conducted by users.

By agreeing to these terms and conditions, you acknowledge and accept the responsibilities and fees associated with CESRA’s fundraising services.
